A local militant named Quanel X is protesting the shooting of two black men. If he protests in that neighborhood again, Im thinking he could end up shot. Biker dudes, rednecks, all screaming to be heard.
Ive seen this thing, heard it from beginning to end...I can't see the justification for smoking both of them. He wanst in danger.....

Don't get me wrong, personally I feel these cats got just what they deserve. If you break into someones house, you have to expect that one day you just might break into the wrong one and get shot. I would like nothing more than to have a tricked out M-4 or hotrod Remington 870 from ScattergunTechnologies. If somebody makes the mistake of breaking into my house, I'm gonna blast them into next week
However, the reality is that we live in a ligitious society and there are several factors in play here. If he really, truly believed that his life (or someone else's) was in danger there would be no dispute. I'm 6'5" and almost 300 lbs. I would be hard pressed to convince someone that I felt my life was threatened by someone shorter than me... but what if they had a bat and were on a crazy meth binge?.. or if I was in a wheel chair? Was he acting for his neighbor to stop the commission of a felony? It's all situational.
Also, there is pre-meditation. It would be non-premeditated if he suddenly indicated that he felt in immediate danger. "Holy Shit!" or some other explitive. Instead, he warned the dispatcher several times that he intended to go outside and shoot them. He contemplated the act.
I ain't passin' judgement on anybody. I wasn't there, and there are a lot more questions than answers. It is only right to leave this to a grand jury. It will be interesting to see if they decide to prosecute. I for one don't think they will. (being Texas, doncha know?....)

This guy's only fuckup is that he was on the phone. He should have hung up, shot them, place objects in plain view that could be used as weapons and then claimed self defense.

Old Grunt, you've again written a well thought out and reasonable arguement, one that I agree with whole heartedly.
One thing I thought of as I read: If Sean Taylor's neighbor had been as concerned for the welfare of his neighbor as our hero in this thread, 3,000 people would not have been attending a funeral in Miami earlier this week.

Keep it simple, Keep it short. But, never EVER say in a 911 phone call... "I am NOT gonna let them get away with this..."
