Bergdahl Charged With Desertion

It's about time.


American soldier and former Taliban captive Bowe Bergdahl has been charged with desertion for his disappearance from an Afghan outpost in 2009, Bergdahl's attorney told ABC News today.

Bergdahl was freed after five years in Taliban captivity in a controversial deal last year in which the U.S. agreed to release five mid- to high-level Taliban figures from detention in Guantanamo Bay, Cuba. As part of the deal, the Taliban five were relocated to Qatar.President Obama called it a "good day" when Bergdahl was freed, but critics, including some high-ranking Republicans, loudly denounced the deal, likening it to negotiating with terrorists. Also, lawmakers complained that Congress had not been consulted about the exchange, as they said the law requires.

After Bergdahl's dramatic return to the U.S., the Army launched an investigation into whether the soldier willfully left his post in Afghanistan before he was taken by the Taliban in 2009, as some Afghan war veterans alleged.

That investigation was concluded last October and was forwarded to senior Army leaders at the Pentagon who then designated Army Forces Command to determine whether he should face punishment. The Army is expected to formally announce Bergdahl's fate later today.

Should he be convicted, what are the odds he will receive a presidential pardon?

The question is what are the odds that the present administration allows it to conclude during his term?

Between the defense asking for time to prepare, the pressure from above to allow it, the actual conduct of the Article 32 and the Court Martial this could take years.

Even if, and that is a big IF, he loses back pay and benefits, I am confident his lawyer(s) are negotiating right this moment for book and movie rights.

Dana Perino, past White House Press Secretary, just reported on Fox that the announcement at Ft. Bragg was a surprise to the Pentagon. Apparently they did not know about the press conference. If so, could this be the dead end of a career?

I agree, even if he's found guilty, which I think he eventually will be, there's just too much backlash from the trade already, but he won't do a day. They'll say his time 'served' with AQ will be it.

When convicted, Bergdahl will be reduced in rank to E-1, forfeit all pay and receive a Dishonorable discharge. Anyone want to bet?
