Well he is still in jail and they are going to retry him. I will assume that the court has a pretty open and shut case and does not want to give him a chance to appeal.

One thing that you have to understand is that the VA is a huge bureaucratic nightmare and if your death certificate doesn't make it to the correct person you will not be marked as dead in the system.
